These terms are the agreement between you and Think Team Sdn Bhd (“Think Team”, “we”, “us”) covering the GOTCHA mobile app, the GOTCHA Pro subscription and the GOTCHA-CAM camera. By creating an account you accept them. If you do not accept them, do not use GOTCHA.

01Who may use GOTCHA

You must be at least 13 years old, and old enough under the law where you live to enter into this agreement — if you are under 18, a parent or guardian must agree on your behalf. You are responsible for everything done through your account, so keep your sign-in credentials to yourself.

02The trial and the subscription

Every new account starts a 7-day GOTCHA Pro trial, granted once per account when you sign up. There is no permanently free tier.
When the trial ends, GOTCHA Pro continues at RM 5.00 per month, billed through Google Play or the Apple App Store, and renews automatically until you cancel.
Your subscription renews at the start of each billing period. Cancelling stops the next renewal; you keep Pro until the end of the period you have already paid for.
Cancel at any time from your store account — Google Play → Subscriptions, or iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
Payment is taken by Google or Apple, not by us. Refunds follow their policies; we can ask them to look at a case, but we cannot issue a store refund ourselves.
If we change the price, we will tell you before the change takes effect, and you can cancel before it applies.

03What GOTCHA does — and what it does not promise

GOTCHA captures a photo, records its position and time, computes a SHA-256 hash of the exact bytes, seals the image with AES-256 on your device, and writes an immutable anchor of that hash with a server timestamp. That makes tampering detectable and gives a capture a verifiable “existed no later than” time.

It does not make anything legally proven. Whether any photo, hash or timestamp is accepted as evidence is decided by a court, a police investigation or an insurer under the rules that apply to them — never by us, and never by this app. GOTCHA is a tool for preserving what you captured, not a guarantee of any outcome.

04GOTCHA is not an emergency service

GOTCHA does not contact the police, ambulance or any emergency responder on your behalf, and alerts to your Guardian Circle depend on networks and devices we do not control. In an emergency, call 999 (Malaysia) or your local emergency number first.

05Using it lawfully

Recording other people is regulated, and the rules differ by country and by place. You are responsible for making sure your use of GOTCHA is legal where you are. You agree not to use GOTCHA to harass, stalk, intimidate or covertly surveil anyone, to record where recording is prohibited, or to break any applicable law.

You also agree not to reverse-engineer, resell or redistribute the app or its firmware, to interfere with our systems, or to attempt to obtain another user’s data.

06Your content

Your captures are yours. We claim no ownership of them. Because they are encrypted on your device with a key held in your device’s keystore, we cannot read them, and we cannot recover them for you if you lose your device and your recovery code.

07GOTCHA-CAM hardware

A GOTCHA-CAM is sold separately and pairs to the phone that first scans its QR sticker. Claiming a camera is first come, first served — that is what stops a stolen camera from being re-registered. Hardware faults are covered by the warranty supplied with the device; these terms cover the software.

08Suspension and termination

You may stop using GOTCHA at any time and ask us to delete your account. We may suspend or close an account that breaks these terms or that we reasonably believe is being used unlawfully. If we close your account without cause, we will refund the unused part of your current billing period.

09Availability and liability

GOTCHA is provided “as is”. We work to keep it running, but we do not warrant that it will be uninterrupted, error-free, or that a capture will always succeed — phones run out of battery, networks drop and cameras get out of range.

To the extent the law allows, Think Team is not liable for indirect or consequential loss, lost profits, or loss arising from evidence not being captured, not being accepted, or being lost. Our total liability for any claim is limited to the subscription fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

10Changes

We may update these terms. If a change materially affects you, we will give notice in the app or by email before it takes effect. Continuing to use GOTCHA after that means you accept the updated terms.

11Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute — without affecting any consumer right you have to bring a claim where you live.
